I agree to the Terms of Declaration Personal Data Disclosure Consent And Acknowledgement* I agree to disclose my personal data to Bakers and Chefs Food Equipment Pte Ltd (“BCFE”) voluntarily to you directly or via a third party who has been duly authorised by me to disclose my personal data to BCFE after (i) I (or my authorised representative) have been notified of the purposes for which the data is collected, and (ii) I (or my authorised representative) have provided written consent to the collection and usage of my personal data for the application of the Transaction and Transaction, or (b) collection and use of personal data without consent is permitted or required by the PDPA or other laws. I authorise BCFE to collect, use, disclose and/or process my personal data (as defined under the Act) or information about me, including but not limited to my name, residential or mailing address, email address, telephone number, photo, income, financial conditions, account details, etc.to process and manage my application to BCFE for the transaction (the “Transaction”) as contemplated by this document, and for BCFE to provide me with any other services and products of BCFE related to or similar with the Transaction. By submitting my personal data, document and information to BCFE, or successfully acquiring products and signing up for any of the services offered by BCFE to me, I am deemed to have agreed with and consented to BCFE to collect, use, disclose and/or process my personal data or information for one or more of the following purposes: (a) processing my enquiries and application for products and services provided by BCFE, as well as products and services by other external providers provided through BCFE if any; (b) performing obligations in the course of or in connection with BCFE’s provision of the goods and/or services requested by me; (c) verifying my identity; (d) managing my relationship and/or account(s) with BCFE; (e) carrying out my instructions or responding to any enquiries by me; (f) carrying out due diligence and other screening activities (including credit bureau and background checks) in accordance with any risk management procedures put in place by BCFE; (g) carrying out due diligence and other screening activities (including credit bureau and background checks) in accordance with legal or regulatory obligations; (h) dealing in any matters relating to the services and/or products which I am entitled to under my account or relationship with BCFE; (i) the recovery of any and all amounts owed by me to BCFE; (j) the process of reviewing my credit periodically, assessing and verification of my ongoing credit worthiness and standing; (k) preventing, detecting and investigating fraud, misconduct, any unlawful action or omission, whether relating to my application or any other matter relating to my account(s), and whether or not there is any suspicion of the aforementioned; (l) managing BCFE’s infrastructure and business operations, and complying with policies and procedures that may be required by law or that may have been put in place by BCFE, including those relating to auditing, finance and accounting, billing and collections, IT systems, data and website hosting, training, testing, business continuity, and records, document and print management; (m) processing of my payment, credit instructions or direct debit facilities; (n) generating internal reports in BCFE (including but not limited to annual, operational and management reports); (o) processing referral payments and commission fees to BCFE’s external partners; (p) administering fee adjustments, refunds and waivers in BCFE; (q) analysing my use of BCFE’s products and services to help BCFE improve, review, develop and efficiently manage the products and services offered to me in future; (r) contacting me for the purpose of verifying my requests or instructions relating to my account; (s) complying with applicable laws, regulations, codes of practice, guidelines or rules, or assist in law enforcement and investigations conducted by any governmental and/or regulatory authority; (t) fulfilling any obligations imposed by BCFE’s bankers or funders; (u) any other incidental business purposes which are deemed reasonably related to or in connection with the Transaction and aforesaid. (collectively, the “Purposes”) In carrying out one or more of the above Purposes, I hereby acknowledge and agree that BCFE may need to disclose or share my personal data to any of the following parties (whether located within or outside Singapore) to carry out one or more of the above Purposes and for the parties to subsequently process my personal data where necessary for the above Purposes: (a) BCFE’s holding company and related corporations (as defined under the Companies Act) (collectively, the "Group"); (b) any of BCFE’s authorised and engaged third party service providers, agents and other organisations in connection with the provision and offering of the BCFE’s products and services to me; (c) any credit reference agency, rating agency, business partner, insurer or broker; bank or financial institution, and, in the event of my default, to debt collection agencies and solicitors appointed by BCFE in the recovery of debts; (d) any credit bureau; (e) BCFE’s bankers, funders, auditors and professional advisors including its company’s secretary and solicitors; (f) any person to whom BCFE is under an obligation to make disclosure under the requirements of any law binding on the BCFE; (g) any other person to whom disclosure is permitted or required by any statutory provision or law; (h) BCFE’s permitted assigns; (i) BCFE’s successors in title; (j) any local or foreign regulatory body, government agency, statutory board, ministry, departments or other government bodies and/or its officials; (k) any contracted persons or third parties engaged by BCFE to provide data and document storage and management services; and/or (l) any authorised service providers whom BCFE would necessarily need to cooperate, interact or work in one way or another in serving me or meeting my requests. If I do not wish for BCFE to use my personal data or disclose my personal data for any of the above Purposes, I am aware that I may withdraw my consent at any time by written notice to BCFE pursuant to the Act, however, depending on the circumstances and the nature/extent of my withdrawal, I am also aware and agree that such request of mine may result in BCFE’s inability to continue providing its goods and services to me and hence may result in the termination of my application, relationship and/or account(s) with BCFE and in such an event I agree that BCFE shall not be liable for any loss or damage arising from the said termination. I agree that upon receipt of my written request to withdraw my consent, BCFE may require reasonable time (depending on the complexity of the request and its impact on our relationship) for my request to be processed and for BCFE to notify me of the consequences of me acceding to the same, including any legal consequences which may affect my rights and liabilities to BCFE. I am aware that in general, BCFE shall seek to process my request within five (5) business days of receiving it. I am aware that withdrawing my consent does not affect BCFE’s right to continue to collect, use and disclose personal data where such collection, use and disclose without consent is permitted or required under applicable laws. To the extent allowed under the Act, I am aware that I may request BCFE to provide me with or give me access to my personal data under BCFE’s possession or control or correct omission or errors in the same. I am also aware that under the Act there are restrictions and exemptions to access and correction of my said personal data and if my said request cannot be complied by BCFE by reason of such restrictions I agree that BCFE shall not be liable for any loss or damage arising from the said restrictions. I shall diligently ensure that all my personal data, information or documents submitted to BCFE is complete, accurate, true and correct and that my failure to do so may potentially result in BCFE’s inability to provide or continue to grant me with any of the products and services I seek or have requested from BCFE and in such an event I agree that BCFE shall not be liable for any loss or damage arising from the said inability. For the avoidance of doubt, in the event that Singapore personal data protection law permits an organisation such as BCFE to collect, use or disclose my personal data without my consent, such permission granted by the law shall apply. BCFE’s rights under this clause shall be in addition to and without prejudice to the BCFE’s other rights of disclosures available at law in Singapore (as may be amended or revised from time to time) or any other statutory provision and in law and nothing herein is to be construed as limiting any of these other rights. Notwithstanding anything stated in any other documents that I may have entered into with BCFE, in the event of any inconsistency the terms of this document shall prevail.
