PRIVACY POLICY (“POLICY”)


This Policy sets out the manner in which Bakers And Chefs Food Equipment Pte Ltd (“BCFE”) collects, uses, manages and protects Personal Data (as defined below) in compliance with the provisions of the Personal Data Protection Act 2012.

This Policy applies to all Individuals and Customers (as defined below) who provide BCFE with Personal Data or whose Personal Data is otherwise collected, used and/or disclosed by BCFE in connection with and/or for the purposes of its operations.

This Policy supplements but does not supersede or replace any previous consent which an Individual or a Customer may have provided to BCFE, nor does it affect any rights that BCFE may have at law in connection with the collection, use and/or disclosure of any Individual or Customer’s Personal Data. Subject to that, BCFE will not collect any Personal Data from an Individual or Customer unless the Individual or Customer has voluntarily chosen to provide us with it.

BCFE may from time to time update this Policy to ensure it is consistent with its future developments or business purposes or to accommodate future changes to applicable legal or regulatory requirements. All updates to this Policy will be published at www.bakersandchefs.com.sg and appropriate notifications of any material revisions will be issued to the relevant persons. Subject to an Individual and Customer’s rights at law, the prevailing terms of the Policy from time to time shall apply. By continuing their relationship with BCFE after any amendments have been introduced and published at www.bakersandchefs.com.sg, Individuals and Customers shall be deemed to have accepted the Policy as amended.

For the avoidance of doubt, this Policy forms part of the terms and conditions, if any, governing an Individual and Customer’s specific relationship with BCFE ("Terms and Conditions") and should be read in conjunction with such Terms and Conditions. In the event of any conflict or inconsistency between the provisions of this Policy and the Terms and Conditions, the provisions of the Terms and Conditions shall prevail to the fullest extent permissible by law.

1.         Definitions

 Data Protection Officer” means the person designated to be responsible for ensuring that BCFE complies with the PDPA;

DNC Registry” means the Do-Not-Call registry maintained by the Personal Data Protection Commission, pursuant to the PDPA;

Individuals” means natural persons, whether living or deceased, and “Individual” means any of them;

Customers” mean the customers of BCFE or buyers or lessees of kitchen equipment who have entered into contracts with BCFE from time to time and guarantors (whether individuals or corporate entities) who have provided guarantees in support of such kitchen equipment leasing contracts;

PDPA” means the Personal Data Protection Act 2012;

Personal Data” means data that is capable of identifying a natural person, whether on its own or in conjunction with other data that is accessible to BCFE;

Personnel” shall include any person engaged under a contract of service or contract for service with BCFE, management personnel, permanent or temporary employees engaged by BCFE from time to time; and

Potential Personnel” shall include any Individual who has submitted an application to be engaged by BCFE as Personnel.

 2. Personal Data Collection

 2.1       Personal Data collected by 
BCFE will only collect, use or disclose Personal Data about an Individual and a Customer which it reasonably considers necessary for the relevant purposes underlying such collection, use or disclosure. Depending on the specific nature of an Individual and Customer’s interaction with BCFE, Personal Data which BCFE collects, uses or discloses concerning an Individual and Customer may variously include the following:

(a) name and contact particulars, including telephone number(s), residential/mailing address(es) and email address;

(b) details of identification documents (such as, NRIC or passport numbers), and applicable visa or permits (such as employment pass, work permit, permanent residency status);

(c) details of occupation, financial position such as assets and income, employer’s details, family members and personal information about them, credit card, bank and giro account;

(d) data about your transactions with BCFE, its service providers, business partners or third parties such as account balances, payment history and account activity;

(e) data from credit bureau reports;

(f) data from credit reporting agencies;

(g) data from governmental agencies, regulatory and statutory authorities;

(h) data for insurance related products;

(i)  data from network usage data and other information gathered automatically by our computer systems, including the computer IP address, links visited and other activities conducted online or using our computer systems;

(j) other information which a Individual and Customer may provide to BCFE, from time to time, in the course of such interaction with BCFE; and

(k) data from publicly available sources.

2.2       BCFE may collect Personal Data about an Individual or Customer in one or more of the following ways:

(a) through application or registration forms submitted;

(b) through correspondence, emails or electronic messages submitted to BCFE or otherwise posted on BCFE’s website(s);

(c) through verbal communications made with BCFE’s Personnel;

(d) through surveys conducted with and/or feedback received from an Individual;

(e) through access to and/or use or navigation of BCFE’s website(s) and its computer network and the use of cookies;

(f) through recordings of the Individual or Customer when attending at BCFE’s premises or at any events or programmes organised by BCFE;

(g) through third party business partners or associates of BCFE; and

(h) when the Individual or Customer submits his/her Personal Data to BCFE for any other reason related to BCFE’s ordinary course of operations.

3.         Purposes for Collection, Use and/or Disclosure of Personal Data

3.1       BCFE may collect, use and/or disclose Personal Data about an Individual or Customer for one or more of the following purposes:

General Business Purposes

(a) managing the administrative and business operations of BCFE;

(b) administering and managing customer relationships;

(c) providing Individuals and Customers with information about goods, services, facilities and/or other benefits being offered or made available by BCFE;

(d) providing Individuals and Customers with information about third party and/or external vendor/supplier promotions, deals and/or other goods and/or services being offered or made available to Individuals and Customers, through partnerships, associations and/or other collaborations involving such third parties or external vendors/suppliers and BCFE;

(e) processing applications for products and/or services;

(f) evaluating and monitoring payment and credit/ financing worthiness;

(g) for evaluation and due diligence purposes;

(h) for data processing purposes;

(i) for evaluating and monitoring of provision of goods and services;

(j) facilitating the completion of transactions;

(k) responding to complaints, queries and/or requests;

(l) conducting market research for statistical profiling, development of goods and services and other purposes in order to improve BCFE’s goods and services;

(m) debt collection purposes;

(n) for assessing, processing and investigating insurance risks and claims;

(o) to enable a party to evaluate any actual or proposed assignment, transfer or novation of rights;

(p) complying with laws, regulations, codes or guidelines binding on BCFE, including disclosures to regulatory authorities or other public bodies;

(q) to main and protect BCFE’s goods and premises;

(r) for accounting, audit and risk management purposes;

(s) safety and security purposes;

(t) preventing, detecting or investigating any actual or crime, fraud, misconduct, unlawful action, breach or dispute; 

(u) record-keeping purposes; and

(v) legal purposes (including but not limited to obtaining legal advice, enforcement of legal rights owed to BCFE and/or our suppliers and dispute resolution).

Personnel

(a) administering and managing Personnel relationships with BCFE, including the provision of services by Personnel;

(b) evaluating the performance of Personnel;

(c) undertaking staff training and quality assurance activities;

(d) providing Personnel with services, facilities and/or other benefits being offered or made available by BCFE to such Personnel as well as information about such services, facilities and benefits.

Potential Personnel

(a) administering and managing BCFE’s relationship with Potential Personnel; and

(b) evaluating the suitability and eligibility of Potential Personnel to be engaged by BCFE.

Event Participants

(a) organising and/or facilitating events or programmes involving Individuals and/or Customers and/or verifying the eligibility of such Individuals and/or Customers to participate in such events or programmes;

(b) tailoring activities or services available to match Individuals and Customers’ preferences; and

(c) promotional and publicity purposes, including recording videos or taking photographs of participants at events.

Visitors and users of BCFE’s facilities

(a) recording and verifying the identity of visitors to BCFE’s premises and users of BCFE’s facilities; and

(b) monitoring the activities of visitors to BCFE’s premises and users of BCFE’s facilities.

Purposes reasonably related to any of the above purposes

(a) for any purposes reasonably related and/or ancillary to any of the abovementioned purposes; and

(b) transmitting Personal Data to third parties engaged by or working in collaboration with BCFE to facilitate any of the above-mentioned purposes.

Purposes for which specific consent was obtained

(a) for any other purposes for which the Individual and Customer’s consent was specifically given or obtained.

4.         Consent

4.1       Unless otherwise authorised under the PDPA or any other applicable law, BCFE will not collect, use or disclose an Individual or Customer’s Personal Data without his/her consent.

4.2       BCFE will take reasonable steps to highlight the purposes relevant to an Individual or Customer, by appropriate means, at the point or time of collection of the Personal Data from such Individual or Customer, including:

(a) via express provisions in contracts, application forms and/or registration forms to be signed with or submitted to BCFE;

(b) via notifications on BCFE’s websites; and

(c) in the course of verbal communications.

4.3       Where feasible, BCFE will inform the Individual and Customer of purposes that are intrinsic to the relationship between BCFE or to the provision of services to such Individual or Customer, as well as purposes that are optional.

4.4       In so far as any purpose(s) are intrinsic to the relationship or provision of services, BCFE reserves the right to decline to engage in the relevant relationship or to provide the relevant services to the Individual and Customer if he or she does not consent to BCFE’s collection, use or disclosure of his/her Personal Data for such purpose.

4.5       Individuals and Customers who:

(a) voluntarily provide their Personal Data to BCFE for the specified purposes;

(b) use or access BCFE’s website(s) or computer network;

(c) enter BCFE’s premises or using any of the facilities thereon; and/or

(d) attend or participate in events or programmes organised by BCFE

will be deemed to agree and consent to BCFE collecting, using and/or disclosing their Personal Data in the manner and for the purposes set forth in this Privacy Policy.

4.6       An Individual or Customer who provides BCFE with Personal Data relating to a third party for any particular purpose, represents and warrants to BCFE that he/she has obtained the consent of the relevant third party to BCFE collecting, using or disclosing such Personal Data for the relevant purpose.

4.7       In so far as BCFE collects Personal Data of an Individual or Customer from any third party(ies) and/or other business partners or associates of BCFE, BCFE will take reasonable steps to inform the relevant third party(ies) of BCFE’s purposes for collecting the Personal Data and to verify that consent from the Individual or Customer has been obtained by the relevant third party(ies) to such disclosure for the intended purpose.

5.         Withdrawal of Consent

5.1       Any Individual or Customer who wishes to withdraw his/her consent to any use or disclosure of his/her Personal Data by BCFE as set out in this Policy may do so by notifying BCFE. BCFE may require up to three (3) weeks from the date of the Individual or Customer’s notification to respond and effect any change.

5.2       Depending on the extent to which an Individual or Customer withdraws consent to any or all use or disclosure of his or her Personal Data by BCFE, such withdrawal of consent may result in BCFE’s inability to provide services to the Individual or Customer and may be considered as a termination by the Individual or Customer of any agreement between BCFE and the Individual or the Customer. BCFE’s legal rights and remedies are expressly reserved in such event.

5.3       In so far as an Individual or Customer’s data is being collected by cookies, the Individual or Customer may disable the use of cookies on his or her internet browser when accessing BCFE’s website. However, BCFE shall not be responsible for any loss of functionality, restriction of the Individual’s use of the website and/or delay or any manner by which BCFE’s website is affected by reason of such cookies being disabled by the Individual or Customer.

6.         Verification of Personal Data & Notification of Changes

6.1       Where feasible, BCFE will take reasonable steps to verify the accuracy of Personal Data received at the point of collection but Individuals and Customers remain primarily responsible and liable to ensure that all Personal Data submitted by them to BCFE is complete and accurate.

6.2       Information voluntarily submitted by an Individual or Customer to BCFE shall prima facie be deemed complete and accurate.

6.3       BCFE will also take reasonable steps to periodically verify Personal Data in its possession, taking into account the exigencies of its operations, but Individuals and Customer are nonetheless required to notify BCFE from time to time, of any applicable changes to such Personal Data.

6.4       BCFE shall not be held liable for any inability on its part to provide services to an Individual or Customer who fails to ensure that his/her Personal Data submitted to BCFE is complete and accurate or who fails to notify BCFE of any relevant changes to such Personal Data.

7.         Disclosure of Personal Data 

7.1       For the purposes above, Personal Data may be provided by BCFE

to :

(a)       companies related to or affiliated with BCFE;

(b)       suppliers or agents of BCFE;

(c)       any financial institution granting or intending to grant any credit/ financing facilities, any credit bureau established in Singapore, authorities/ agencies established by the Monetary Authority of Singapore and/or any other person as may be authorised by law or any governmental and/or regulatory and/or industry related association/ authority (whether based in Singapore or otherwise);

(d)       any relevant agent, contractor or third party service provider who provides administrative, legal, tax, telecommunications, computer, securities clearing, management, audit or other services to BCFE;

(e) any banking, financial or other institutions which BCFE has dealings with;

(f) any credit agency or debt collection agencies;

(g) any insurance operators and any association or federation of insurance companies;

(h) any person or corporation to whom BCFE transfers, assigns or novates any part of its interests, obligations, business and/or operations;

(i) any person by whom BCFE is required by applicable legal, governmental or regulatory requirements to make disclosure; or

(j) the Customer’s agent, executor or administrator, receiver, receiver and manager, judicial manager and any person in connection with any compromise, arrangement or any insolvency proceedings relating to the Customer and any authorised signatory of the Customer;

(k) a guarantor or any person providing security or credit support for the Customer’s obligations;

(m) any director, partner or authorised signatory of the Customer’s contracts with BCFE or any joint account holder of the kitchen equipment leasing facility or account under such contracts;

(n) any other third party acting for BCFE in connection with the enforcement of BCFE’s rights and remedies under its contractual agreements with its Customers;

(o) any other person reasonably requiring the same in order for BCFE to carry out the activities set out in the above purposes.

8.         Policy on Telephone Numbers Registered With The DNC Registry

8.1       BCFE  is prohibited from sending unsolicited telemarketing messages (“specified messages”) to Singapore telephone numbers through voice calls, text or fax messages registered on the DNC Registers unless BCFE has obtained the relevant Individual or Customer’s clear and unambiguous consent in written or other accessible forms.

8.2       In compliance with the PDPA, BCFE will not send specified messages to telephone numbers that appear on the DNC Registry unless the relevant Individual or Customer has given BCFE clear and unambiguous consent to do so.

8.3       BCFE will continue to contact Individuals and Customers at the telephone numbers provided to BCFE in the limited circumstances allowed under the DNC Registry even if these telephone number are registered with the DNC Registry. 

9.         Protection of Personal Data

9.1       BCFE shall make reasonable security arrangements to prevent unauthorised access, collection, use, disclosure, copying, modification, disposal or similar risks to Personal Data in its possession.

9.2       If BCFE transfers Personal Data outside Singapore, BCFE will take reasonable steps to ensure that such Personal Data transferred receives a standard of protection comparable to the protection received under the PDPA.

9.3       BCFE will ensure that third parties who receive Personal Data from BCFE protect such Personal Data in a manner consistent with this Policy and not use such Personal Data for any purposes other than those specified by BCFE, by incorporating appropriate contractual terms in its written agreements with these third parties.

9.4       BCFE is not responsible in any way for the security and/or management of Personal Data shared by Individuals or Customers with third party websites accessible via links on BCFE’s website. 

10.       Access and Correction of Personal Data

10.1     Any Individual or Customer who:

(a) has questions or feedback relating to this Policy;

(b) would like to obtain access to his/her Personal Data held by BCFE;

(c) would like to obtain information about the ways in which his/her Personal Data held by BCFE has been or may have been used or disclosed by BCFE in the year preceding the request; and/or

(d) would like to update or make corrections to his/her Personal Data held by BCFE

such requests should be directed to the Data Protection Officer of BCFE.

Individuals and Customers should note that BCFE is not required, under the PDPA, to provide access and correction to Personal Data in certain situations.

10.2     The PDPA allows and BCFE reserves the right to charge a reasonable fee for the handling and/or processing of access requests by an Individual or Customer pursuant to Clauses 10.1 (b) or (c) above.

10.3     BCFE may require up to three (3) weeks from the date of the Individual or Customer’s request to respond and effect any change. 

11.       Governing Law

This Policy shall be governed by and construed in accordance with the laws of Singapore. Any dispute arising out of or in connection with this Policy including any question regarding its existence, validity or termination, shall be exclusively referred to and finally resolved by the Courts of Singapore.
